Biffer terms of use and sale
This English translation is provided for convenience; the French version on biffer.fr prevails.
These terms of use and sale govern the use of the Biffer software, in both its free plan and its unlimited plan, and the purchase of a license on the website biffer.fr (including its English version biffer-software.com). The software and the website are published by OPCADIA, a French limited liability company (SARL) whose registered office is at 80 cours Docteur Long, 69003 Lyon, France, registered with the Lyon Trade and Companies Register (RCS) under number 529 187 395, represented by its manager Romain Rissoan, trainer and consultant. They apply to every user, consumer or professional, from the first sign-in in the software, and to every buyer at the time of ordering, who accepts them without reservation.
They describe what is permitted and prohibited, what you are buying, the license check, the right of withdrawal, our warranties and how disagreements are settled. The legal notice and the privacy policy complement this document.
Purpose, plans and prices
Biffer is desktop software for anonymizing documents that works offline. A license confers a right of use, without transfer of ownership.
The software can be used free of charge, with no time limit, for 5 files per month, after an email sign-in carried out once in the software on each computer; this sign-in delivers the key tied to the address and to the machine, and the software cannot be used without it. Every feature is available in this free use; only the number of files per month is limited, with the counter kept on the computer and reset on the first day of each month. For an unlimited number of files, two products are offered, detailed on the pricing page:
- Biffer for Mac, €10 excl. VAT (€12 incl. VAT): a license for one computer running macOS, for life for the major version purchased, unlimited number of files.
- Biffer for PC, €10 excl. VAT (€12 incl. VAT): a license for one computer running Windows, for life for the major version purchased, unlimited number of files.
Prices are shown in euros excluding and including taxes, with French VAT at the applicable rate included. The applicable prices are those displayed at the time of the order; any later change has no effect on licenses already acquired. An order may cover several licenses.
Order, payment and key delivery
Orders are placed from the Get Biffer page. The buyer creates an account with an email address, signs in through the link received at that address, chooses the product (Mac or PC) and the quantity, then pays by card. Payment is processed by Stripe Payments Europe, Ltd. (Dublin); card details never pass through our servers. The order is firm upon receipt of payment. Stripe sends a receipt by email; our confirmation email contains the links to the invoice (online view and PDF) and, when the computer is already known to us, the unlimited key intended for it.
The license is made available in the account as soon as payment is confirmed. The unlimited key is then delivered in the software by signing in with the same email address on the computer concerned, or retrieved automatically at the next license check; the buyer can also generate it from the account by entering the computer ID shown in the software. The key is tied to the account's email address and to that ID; it is verified locally and the software works without a connection after activation.
- A license covers a single computer. A second computer, Mac or PC, requires a second license.
- The license is attached to the computer on which the key was delivered and is not transferable. If the computer is changed, the operating system is reinstalled, the motherboard is replaced or any change is made that alters the computer's technical ID, the key no longer matches and the user cannot request a new license free of charge: a new license must be purchased. We recommend making the necessary backups before any reinstallation.
- For an order of several licenses, the account holder assigns them to colleagues by their email address; each one receives their key by signing in to the software with that address. The holder can withdraw an assignment, which revokes the corresponding key and frees up the license.
License to use and prohibited uses
Whether free or unlimited, the license granted is personal, non-exclusive, non-assignable and valid for a single computer. It takes the form of a key generated for a specific computer: the key is tied to the user's email address and to that computer's technical ID, and works nowhere else. It may not be sold, lent or transferred to another computer, including after a reinstallation of the system; in that case, the user buys a new license.
We warn every user against fraudulent uses, which expose those responsible to the penalties described below. The following are prohibited, without limitation:
- sharing, lending, reselling, renting or publishing a license key or the machine ID associated with it;
- installing or attempting to activate a key on a computer other than the one for which it was generated, or altering its content;
- circumventing the free plan's monthly counter, in particular by manipulating or deleting the counter files, creating several accounts with different email addresses, or presenting a falsified machine ID;
- decompiling, disassembling, modifying or redistributing the software, except where strictly permitted by law, or extracting its detection models or embedded resources;
- using Biffer for an unlawful activity, including practices prohibited by the EU regulation on artificial intelligence (Regulation (EU) 2024/1689, known as the AI Act), or to infringe the rights of third parties;
- assigning purchased licenses to people outside the organization that holds the account for the purpose of resale.
The Biffer software, its code, interface, detection models and documentation are protected by copyright and remain the property of OPCADIA. The user remains free to process as many documents as they wish within the limits of their plan, on as many computers as they have licenses, and to keep the version acquired with no time limit.
License checks, suspension and penalties
The software may check the validity of its key with biffer.fr. This check takes place when the software is opened, at most once a day, and at the user's request when they click the button to check the license and updates in the software's account settings. It sends the computer ID, the key, the software version and the operating system; the server also records the IP address and the date of the request. In return, the software learns the status of its key and the number of the latest available version and, if a purchase has been linked to this computer, receives its unlimited key. No document, no detected data and no counter is sent, and the absence of a connection does not prevent the software from working. Details of this processing are given in the privacy policy.
Abnormal use includes, in particular, presenting the same key from several computers or an unusual number of IP addresses, presenting a revoked or altered key, or a counter that has clearly been tampered with. In such cases, we inform the holder by email and give them fifteen days to provide an explanation; we may suspend the key in the meantime if the use continues. Proven fraud results in the permanent revocation of the key and the termination of the license, without refund.
Termination does not deprive OPCADIA of its other remedies. Using software in breach of its license, or reproducing or distributing it without authorization, may constitute infringement within the meaning of Article L335-3 of the French Intellectual Property Code and may give rise to civil and criminal proceedings, in addition to compensation for the harm suffered.
Right of withdrawal, license term and changes to the offer
A consumer buyer has fourteen days from the order to exercise their right of withdrawal, without having to give reasons. However, the license is digital content supplied on an intangible medium, whose performance begins immediately after payment. By requesting immediate delivery of their license, the consumer buyer expressly agrees to the immediate performance of the contract and acknowledges that they waive their right of withdrawal, in accordance with Article L221-28 of the French Consumer Code. This agreement is collected through a checkbox at the time of the order; the free plan lets you try the software before any purchase. The right of withdrawal is explained on service-public.fr (in French). It does not apply to professional buyers, except in the cases provided for by law.
The unlimited license is granted for life for the major version acquired, currently version 1: it does not expire and the software does not deactivate. Minor updates to this version (fixes, improvements, new detection fields) are provided at no extra charge. Each new major version (2, 3 and beyond) is a new product, offered for purchase at the price displayed on its release; the buyer remains free to keep using the version they own.
The software is provided "as is", as described on the website on the date of purchase. We may change the free plan (number of files, features included, sign-in arrangements) with one month's notice announced on biffer.fr, without this change affecting unlimited licenses already acquired.
Warranties, liability, governing law and mediation
Biffer is a tool to assist with anonymization. No automatic detection is exhaustive: some data may escape the analysis and some items may be flagged wrongly. Consequently, the user reviews each output document and remains solely responsible for its content and its disclosure to a third party, including an artificial intelligence service; we do not guarantee that the processed document complies with any given legal obligation, in particular the GDPR or professional secrecy; we cannot be held liable for undetected data, a false positive, loss of a mapping table or indirect damage; for a professional buyer, our liability is limited to the amount of the license concerned. These limitations do not affect the statutory warranties enjoyed by the consumer buyer, in particular the legal guarantee of conformity for digital content.
Support is provided by email at contact@biffer.fr and through the report form; it covers installation, key activation and software defects, excluding any legal advice; the processed document must never be sent to us.
These terms are governed by French law; only the French version is authoritative. In accordance with Articles L611-1 et seq. of the French Consumer Code, a consumer buyer may, after contacting us, use a consumer mediator free of charge. Contact details of the competent mediator: [mediator to be completed]. The list of approved mediators is published by the Commission de la médiation de la consommation (French consumer mediation commission).
Failing an amicable resolution, the French courts have jurisdiction: the court for OPCADIA's registered office, in Lyon, for a professional; the rules of the French Code of Civil Procedure and Consumer Code for a consumer. If any clause is declared void, the others remain applicable. The applicable version is the one in force on the date of the order or, for the free plan, on the date of use.
